PLEASE READ THESE TERMS AND CONDITIONSCAREFULLY. BY SIGNING UP FOR OR PARTICIPATING IN myPerks® OR OTHERWISE AGREEINGTO THESE TERMS AND CONDITIONS, YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND RECOGNIZE THAT YOU MAY BE WAIVING CERTAIN RIGHTS.

 

THESE TERMS AND CONDITIONS ARE SUBJECT TO THE BINDING ARBITRATION AGREEMENT  IN THE TERMS OF USE, WHICH LIMITS YOUR RIGHTS TO BRING AN ACTION IN COURT, BRING A CLASS ACTION, AND HAVE DISPUTES DECIDED BY A JUDGE OR JURY, AS WELL AS PROVISIONS IN THE TERMS OF USE  THAT LIMIT OUR LIABILITY TO YOU.

YOUR CONTINUED PARTICIPATION IN myPerks® IS SUBJECT TO YOUR CONTINUED COMPLIANCE WITH THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT PARTICIPATE IN myPerks®.

 

CONTINUED PARTICIPATION IN myPerks® AFTER CHANGES HAVE BEEN MADE TO THESE TERMS AND CONDITIONS CONSTITUTES YOUR ACCEPTANCE OF THE REVISED TERMS AND CONDITIONS THEN IN EFFECT. YOU AGREE THATYOU WILL REVIEW THESE TERMS AND CONDITIONS PERIODICALLY AND THAT YOU SHALL BEBOUND BY THESE TERMS AND CONDITIONS AND ANY MODIFICATIONS TO THEM.

Eligibility

The Giant Eagle myPerks® program (“Program”) is open to US residents, who are 18 years of age or older and in good standing with Giant Eagle®, who have signed up for the Giant Eagle Advantage Card®, and who possess either a valid Giant Eagle Advantage Card®, a valid Ricker’s Reward card or a digital account on gianteagle.com or in the Giant Eagle® app or GetGo® app (“Card”), all free of charge and no purchase required to be a member. To participate, customers must agree to these myPerks® Terms and Conditions, which become part of the Terms of Use and the Privacy Notice. Capitalized terms that are not defined here will have the same meaning given to them in the Terms of Use and Privacy Notice.

We hope you will familiarize yourself with these myPerks® Terms and Conditions, because they reflect our understanding of how the Program operates, what you can expect from us, and what we expect from you. If there’s anything you don’t understand, ask us, either by sending us a note or calling Customer Care at 1–800–553–2324.

 

Beginning in September 2020, customers in certain markets will be invited to trial or placed into a loyalty Program called myPerks®. The Program features two reward tiers, myPerks Memberand myPerks Pro®. Customers are eligible for myPerks Pro® based on how many perks they have earned in an established earning period or by the number of Qualifying Trips (as defined in the Section titled, myPerks Pro® Membership Section) made to GetGo® during that same time period (as defined in the Section entitled myPerks® Earning and Membership Periods below). Customers who are not eligible for myPerks Pro® can participate in the myPerks Member™ tier.

Both features of the Program allow customers to earn perks and redeem them for discounts. The myPerks Pro® tier feature of the Program gives customers advantages over the myPerks Member™ tier feature, including earning opportunities, earning perks at a quicker rate, and offers of additional perk earning opportunities among other benefits. Customers must earn 2,500 perks during the earning period or make 25 Qualifying Trips to GetGo® during the same time period. (as described below in myPerks® Earning and Membership periods) to continue in the myPerks Pro® tier. Otherwise, their membership will revert to the myPerks Member™ tier.

 

Transition from fuelperks+® to myPerks®

Customers who transition to the Program will have their fuelperks+® converted so they can be redeemed as “dollars off rewards” which are available under the Program and agree to follow the applicable rules for the myPerks Member™ features or myPerks Pro® features of the Program described in these myPerks® Terms and Conditions. Customers’ fuelperks+®will convert to myPerks Member™ or myPerks Pro® rewards if eligible within 48 hours after their transition to the Program.

Earning Perks

myPerks Member™ - Each time you use your Card, a myPerks Member can earn 1 perk for every $1 spent inside Giant Eagle®, Market District® and GetGo®(“Participating Locations”) – including on groceries, prescription co-pays, Curbside  Pickup & Delivery orders, and gift cards (subject to certain exclusions and limitations as outlined in the Exclusions and Purchase Restrictions section below), each a (“Qualifying Purchase”). You also earn 2 perks for every 1 gallon of fuel you pump at GetGo®, and 5 perks on every qualifying prescription you fill.

 

myPerks Member™ Earning

·     1 Perk = $1 spent on groceries and gift cards (at Participating Locations on eligible purchases) 

·     2 Perks = every 1 gallon of fuel 

·      5Perks = each qualifying prescription filled 

·     1 perk per $1 spent on qualifying Our Brand Products (see definition that follows) earned immediately; (then multiplied by 2 and added within 48 hours)  

Our Brand Products - means select Giant Eagle®, Market District®, Nature’s Basket® and Great-to-Go® labeled items, including certain items in the following departments: grocery, health, inedible grocery, dairy, frozen foods, frozen meat, baby, breakfast/baking, beauty, packaged beverages, grab and go, candy, packaged bread, prepackaged salads, kosher, salty snacks, prepackaged sweet snacks, alternative snacks, packaged ice cream/novelties, and personal care items. Deli, produce, meat, seafood, prepared foods, bakery and other departments not listed above are not included in the discount.

 

A myPerks Member™ will earn 2x perks and Pros will earn 3x perks on all Our Brand Products.

 

myPerks Pro® - Each time you use your Card, a myPerks Pro® earn more perks on Qualifying Purchases, which are added to their account balance within 48 hours.

 

myPerks Pro® Earning

·      1 perk per $1 spent on qualifying groceries earned immediately and then multiplied by 50%. Your total perks balance will be reflected in your myPerks® account within approximately 48 hours.   

·      1 perk per $1 spent on qualifying gift card earned immediately; (then multiplied by 2 and added within 48 hours).

             ○ Gift cards can earn a maximum of 5x perks. This means that on days or for purchases where you are eligible to receive additional perks multipliers, you will not receive more than 5x the perks amount of your gift card purchase price.  For example, if you buy a $100 gift card, you earn 100 perks immediately and another 50 perks as part of your myPerks® multiplier. On bonus days, you may receive additional perks, but you will only be eligible to receive a maximum of 500 perks total for your gift card purchase. Your total perks balance will be reflected in your myPerks® account within approximately 48 hours.

·      2 perks on each fuel gallon earned immediately and then multiplied by 50%. Your total perks balance will be reflected in your myPerks® account within approximately 48 hours.

·      5 Perks for each qualified prescription filled earned immediately and then multiplied by 100% for a total of 10 perks. Your perks balance will be reflected in your myPerks® account within approximately 48hours.

·     1 perk per $1 spent on qualifying “Our Brand Products” earned immediately and then multiplied by 3. Your perks balance will be reflected in your myPerks account within approximately 48 hours.

 

A myPerks Pro® will earn 2x perks and will earn 3x perks on all Our Brand Products.

 For example: if a myPerks Pro® spends $100 on qualifying groceries they will earn 100 perks immediately and another 50 perks will be added to their account within 48 hours.

 

A myPerks Pro® will receive the 50% perk multiplier on bonus perks and perks earned through Perks digital challenges.  

 

A myPerks Member and myPerks Pro® will also earn perks on purchases when redeeming rewards as described below.

 

Redeeming Perks

For a myPerks Member and myPerks Pro®, for every 50 perks accumulated on Qualifying Purchases, you can enjoy a reward redeemable for $1 off your next purchase at Participating Locations. A myPerks Member and myPerks Pro® will earn perks on purchases when redeeming rewards. When you use the value of the redeemed perks to make a purchase at Participating Locations, you will earn perks on the items purchased in the redemption transaction, excluding items paid for with dollar rewards. For example, if you have $10 in dollar rewards and spend $100, you will earn perks on the $90 you paid and not on the remaining $10 you received as a reward for your accumulated perks.

 

Disclaimers:

·     If redeeming perks on a fuel purchase at GetGo®, the reward/discount must be used in a single transaction for one vehicle.

·     Customers can redeem as many myPerks rewards/discounts as they have available in one transaction on eligible items but cannot redeem an amount greater than the transaction total.

 

Expiration of Perks

PLEASE NOTE THAT WE HAVE EXTENDED THE PERKS EXPIRATION PERIOD TO MARCH 31, 2023. This means that you can use your perks until March 31, 2023, at which time any remaining perks will expire in accordance with these myPerks® Terms and Conditions and any other information we have provided regarding the switch from fuelperks+ to myPerks.

After March 31, 2023, the expiration of perks are as follows:

myPerks Member™

myPerks Member perks will expire at the end of the third full month after they are earned if not used. For example, perks earned anytime in January will expire on April 30.

 

myPerks Pro®

myPerks Pro® perks will expire at the end of the next full calendar month after one year of non-use. For example, perks earned anytime in March 2020 will expire on April 30, 2021 for myPerks Pro®.

If a myPerks Pro® fails to meet requirements to maintain myPerks Pro® tier level benefits at the commencement of the new earning period, their account will revert to a myPerksMember and any perks in the account will simply become subject to the myPerksMember expiration schedule on the date of the account transition. For example, if a myPerks Pro® member account transitions to a myPerks Member™ account on September 15, the customer will have until December 31 to use those perks.

If a myPerks Member™ meets eligibility requirements to enter myPerks Pro®, any perks in their account will become subject to the myPerks Pro® expiration schedule beginning on the date the account transitions to myPerks Pro®.

 

myPerks Pro® Membership

Customers can become a myPerks Pro® by:

1.    earning 2,500 perks  

2.   or, making 25 Qualifying Trips to GetGo® within the earning period.

 

A “Qualifying Trip” is when a customer makes a purchase of at least $5 inside GetGo® or purchases as least 5 gallons at a GetGo® pump. Each GetGo® transaction counts separately.

 

The following purchases and perks will be counted towards the 2,500 perk threshold needed to earn and maintain a myPerks Pro® account:

·     base perks earned on groceries purchases in Participating Locations, 1 perk earned per $1 spent

·     base perks earned on gallons purchased, 2 perks earned per gallon pumped

·     base perks earned on prescriptions filled, 5 perks earned per qualifying prescription

·     bonus perks earned through promotions and challenges as available and described in the promotion or challenge terms

·     gift card purchases

 

The following purchases and perks do NOT count towards the 2,500 perk threshold needed to earn and maintain a myPerks Pro® account:

·     gift card bonus perks

·     Extra perks earned by myPerks Pro® (.5 bonus perks on groceries, additional 1 perk per gallon and additional 5 perks per qualifying prescription)

 

myPerks® Earning and Membership Periods

Earning and membership periods occur in 6-month intervals: January to June and July to December. Perks earned during the earning period count towards the 2,500-perk threshold needed to reach a myPerks Pro® account for the associated membership period. If a customer reaches the 2,500-perk threshold or makes 25 Qualifying Trips to GetGo® at any time during the earning period, they will be placed into myPerks Pro® the next day, and will maintain that membership through the end of that earning period and the associated membership period.

 

Earning period: January – June = Membership period: July – December

Earning period: July – December = Membership period: January – June

For example, if a customer transitions to myPerks Pro® on October 20, 2020, (July to December earning period), they will be put into the myPerks Pro® program on October 21 and will maintain myPerks Pro® status through June 30, 2021.

 

Conversely, if a customer does not earn the required 2,500 perks or make 25 Qualifying Trips to GetGo®, their myPerks Pro® account will revert to a myPerks Member™ account. They will be eligible to transition back to myPerks Pro® once they earn the required 2,500 perks or make 25 Qualifying Trips to GetGo®.

 

 

Additional Program Details

You must present your Card to be scanned at the time of purchase at Participating Locations. If you forget to scan your Card but have your receipt, please contact the Giant Eagle Customer Care department at 1-800-553-2324 with your receipt information, they may be able to assign the proper perk amount to your Card for that transaction.

 

Perks and rewards will be tracked electronically on your Card or digital account and will be displayed on your receipt, in the Giant Eagle® or GetGo® mobile apps (if you have downloaded it to your smartphone), and on our websites, located at gianteagle.com, marketdistrict.com, and getgocafe.com.

 

The newest version of the physical Card (which was available in some markets as early as July 2019) is ready to earn perks right away, but you must visit fuelperksplus.com and enroll the card under your name to start redeeming perks. If you don’t have access to a computer, visit the Customer Service Desk at your local Giant Eagle® or Market District® and they will help you enroll your Card.

 

Calculating Discounts

When you redeem your perks for rewards/discounts on purchases, the amount of discount you receive is calculated after all store discounts, all coupons (including manufacturer coupons), gift card purchases and anything listed in the Exclusions and Purchase Restrictions below have been subtracted from the order.

 

Special Promotions

From time to time, Giant Eagle®, Market District®, and GetGo® will offer special promotions to a specific customer database, or a geographic market, that may not be offered to everyone. If you are part of that special market, notice will be made to you via in-app messaging, store signage, circular distribution, or through email if you have provided one. Information on the details, limitations, perks accumulation, and expiration of these special promotions will be included in the notice.

 

Exclusions and Purchase Restrictions

Perks are not earned on purchases of alcohol and tobacco products, price-controlled milk products(PA only), and any other items prohibited by law. Perks are not earned on state and federally funded prescription purchases, including, but not limited to Medicare, Tricare, Medicaid, and PACE, excluding out-of-pocket pharmacy totals, (such as deductibles and co-payments for prescriptions). Perks are not earned on Giant Eagle®, Market District®, or GetGo® gift card; or on Visa prepaid reloadable cards. Amazon.com gift cards earn perks at a rate of one-half of a perk for each $1 spent on such gift cards and are excluded from any bonus perks offers or events.

 

Postage stamps, kerosene, money orders, Western Union, WetGo Unlimited® and moneytransfer transactions are not eligible for perks. Purchases for entertainmentoptions such as Redbox or similar services, amusement or entertainment tickets,Market District® cooking school classes, and wine or beer dinner tickets do notearn perks. Administrative activities, including but not limited to thepurchase of copy or fax machine services, delivery charges, fundraisingactivities, donations, returned check services fees, do not earn perks.  In all cases, you do not earn perks on theamount of sales tax and/or other taxes paid in any transaction.

Redemption Exclusions and Restrictions

Perks redeemed for rewards cannot be applied as discounts toward the purchase of any of the following: gift cards, telecom products, alcohol or tobacco products, price-controlled milk products purchased in Pennsylvania, kerosene, Visa prepaid reloadable cards, any prescriptions (including third party insurance or government programs such as Medicare, Tricare, Medicaid or PACE programs),lottery tickets, postage stamps, money orders, Western Union money transfer transactions, Redbox, amusement or entertainment tickets, Market District® restaurant purchases, Market District® cooking school classes, wine or beer dinner tickets, copy or fax machine service, delivery charges, fundraising activities, donations, returned check service fees, and any other items prohibited by law. Perks are never redeemable for cash, have no direct cash value and are not valid with any other offer, except as outlined herein or in the Special Promotions section above or elsewhere in these terms and conditions. Perks and rewards cannot be sold or in any way transferred to other Card accounts, people, or organizations. You may be removed permanently from the Program or suspended for engaging in any actions that, in the sole and exclusive determination of Giant Eagle®, undermine or attempt to circumvent these terms, the fair use, and/or fair play of the Program. Only one Card and account per natural person. Specific to fuel, you are limited to a maximum of five fuel redemptions per day and 30 fuel redemptions in any calendar month.

PROGRAM MODIFICATIONS AND TERMINATION

GIANT EAGLE®, MARKET DISTRICT®, AND GETGO® RESERVE THE RIGHT TO DISCONTINUE, REDUCE OR MODIFY THIS PROGRAM AT ANY TIME, EITHER ACROSS MARKETS OR WITHIN SPECIFIC STORE OR GEOGRAPHIC MARKETS, AND WITH LIMITED OR NO ADVANCED NOTICE.

Any significant changes to the Program that affect everyone will be reflected in these myPerks® Terms and Conditions. Any significant changes to the Program(other than Special Promotions, which will be communicated as outlined below)that affect only specific markets, will be reflected in store signage, circular or other messaging and email communications, if you have provided your email address or otherwise communicated to you. Any significant changes to the Program will be prospective and you will have an opportunity to redeem any previously earned perks prior to the effective date of the changes to the Program.

TERMS OF USE AGREEMENT

These myPerks® Terms and Conditions are in addition to our Terms of Use and shall be read together as one and the same instrument; provided, that if there is a conflict between any terms set forth in these myPerks® Terms and Conditions and Terms of Use Agreement, these myPerks® Terms and Conditions will govern. For the avoidance of doubt, in the event of any action, proceeding or other dispute arising from or relating to these myPerks® Terms and Conditions, , such dispute shall be settled in accordance with the provisions and procedures set forth in our Terms of Use. THE LIMITATION OF LIABILITY, CLASS ACTION WAIVER, AND ARBITRATION PROVISIONS DETAILED IN THE TERMS OF USE GOVERN THESE MYPERKS® TERMS AND CONDITIONS.

The information we collect is used in accordance with these terms and as is outlined in our Privacy Notice, located here.
