The Giant Eagle “myPerks Team Member Sweepstakes” (“Sweepstakes”) starts at 12:00am, Eastern Standard Time (“EST”), on October 11, 2021 and ends at 12:00am, EST, on January9, 2022 (“Sweepstakes Period”). The sponsor of the Sweepstakes is Giant Eagle (“Giant Eagle”), 101 Kappa Dr, Pittsburgh, PA 15238. This Sweepstakes is in no way sponsored, endorsed and/or administered by any owners or operators of any social media forums where Giant Eagle advertises or promotes this Sweepstakes.The Sweepstakes is subject to these Sweepstakes rules (“Official Rules”), and by entering the Sweepstakes, entrant (“Entrant”) agrees to be bound by them and the decisions of Giant Eagle, which shall be final in all matters related to the Sweepstakes.

ELIGIBILITY: Sweepstakes is open only to Team Members and Employees of GiantEagle who have switched to myPerks, are Advantage Card holders, and are enrolled in the Team Member Own Brand Discount. Members of the ‘Top 25’ Executive Leadership Work Location are excluded.

ELIGIBLE ENTRANTS MUST ENTER IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. Participation in the Sweepstakes constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules.

HOW TO ENTER: During the Sweepstakes Period, an Entry may be submitted on Giant Eagle’s Team Member myPerks web page (the “Entry Process”):

For Entry via Giant Eagle’s Team Member myPerks web page: Visit https://www.gianteagle.deals/myperks/team-members and click on the “Make the Switch” link and follow the prompts to switch to myPerks. You must be a Giant Eagle Advantage Card holder and be enrolled in the Team Member Own Brand Discount to secure your Entry. Members of the ‘Top 25’ Executive Leadership Work Location are excluded.

If Entrant participates via the Entrant’s wireless phone, wireless phone charges and data rates may apply.

Team Members and Employees that are already in myPerks will be entered automatically.

Limit one Entry per Entrant. Giant Eagle’s database clock will be the official timekeeper for this Sweepstakes.

Use of any software or other device to automate an Entry or subvert the Entry Process is prohibited, and all Entries submitted through such devices are void. Any attempt by any Entrant to obtain more than one Entry by using multiple/different e-mail addresses, identities, registrations, log-ins or any other methods will void that Entrant’s Entries and Entrant may be disqualified. Giant Eagle reserves sole discretion to disqualify any Entry.

ODDS: The odds of winning depend on the total number of eligible entries received during the Sweepstakes Period. Giant Eagle cannot accurately predict the number of Entrants who will participate in the Sweepstakes.

WINNER SELECTION& PRIZES: A total of twenty-four(24) winners (each, a “Winner,” and collectively, “Winners”) will be selected by random drawing from all eligible Entries to receive a prize.

October: Nine (9) total Winners, three (3) Winners per week, will each receive 200,000 myPerks Perks which equals $4,000 reward dollars (each, a “Prize,” and collectively, “Prizes”).

November: Ten (10) total Winners, two (2) Winners per week, will each receive 150,000 myPerks Perks which equals $3,000 reward dollars (each, a “Prize,” and collectively, “Prizes”).

December and January: Five (5) total Winners, one(1) Winner per week, will each receive 100,000 myPerks Perks which equals $2,000reward dollars (each, a “Prize,” and collectively, “Prizes”).

Total estimated retail value of all Prizes: 3,800,000 myPerks Perks or $76,000 in reward dollars.

Entrants are only eligible to receive one Prize. If an Entrant receives a Prize prior to the end of the Sweepstakes, she or he cannot participate in any future drawing(s).  No substitutions or transfers of Prize or cash redemptions are permitted, Giant Eagle reserves the right in its sole discretion to substitute prizes of comparable value if Prize is unavailable, in whole or in part, for any reason. Prize is nontransferable, nonassignable, and not returnable. No portion of Prize may be sold, bartered, or exchanged.

NOTICE TO POTENTIAL WINNERS AND VERIFICATION: On or about 11:59pm, on 1/15/2022, Giant Eagle will notify the Winners through HR that they have potentially won a Prize. Each Winner will have seven (7) days to respond to Giant Eagle’s notification, and verify eligibility (the “Eligibility Verification Process”); otherwise, another Winner may be randomly  selected. A valid Giant Eagle Advantage Card enrolled in myPerks is required in order to claim the Prize, which will be added to the Winner’s Giant Eagle Advantage Card at Giant Eagle’s cost.  Furthermore, except where legally prohibited, to complete the Eligibility Verification Process each potential Winner must sign and return, within seven (7) days of being notified, a Declaration of Eligibility; Liability and Publicity Release to claim a Prize.

Receiving a Prize is contingent upon compliance with these Official Rules.  Each Winner is subject to verification by Giant Eagle. An Entrant is not a Winner of any Prize, even if the notification should so indicate, unless and until an Entrant who is a Winner has been verified and Entrant has been notified that verification is complete.

Once a Winner receives his or her Prize from Giant Eagle, Giant Eagle is not responsible for reimbursing such Winner for any theft, destruction, manipulation, or loss associated with his or her Prize.

GENERAL PRIZE RULES:  GiantEagle is not responsible for misdirected, incomplete, lost, late, illegible, undelivered, inaccurate or delayed Entries; technical, hardware or software failures of any kind; lost or unavailable network connections; failed, incomplete, garbled or delayed computer transmissions; or other errors or problems that may limit or affect a person’s ability to participate in the Sweepstakes, whether human, mechanical, typographical, printing, electronic, network, or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the Prize or in any Sweepstakes-related materials. If for any reason the Sweepstakes is not capable of running as planned, including, but not limited to, events of sabotage, fraud, acts of God, pandemics, terrorism or threats thereof, computer viruses or other events or causes beyond Giant Eagle’s control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, or in Giant Eagle’s sole opinion, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes or the granting of any Prize, or any component thereof, Giant Eagle reserves the right, at its sole discretion, to modify, cancel or suspend the Sweepstakes. In the event of cancellation, Giant Eagle reserves the right to award the Prize from among all remaining eligible Entries received prior to the event requiring such cancellation. In the event that Giant Eagle determines that there are no eligible Entrants, Giant Eagle reserves the right, at its sole discretion, not to award the Prize (or any portion thereof). False or deceptive Entries or acts will render Entrant ineligible.

ANY ATTEMPT BY AN ENTRANT ORANY OTHER INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BEMADE, GIANT EAGLE RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

PRIVACY: All information collected by Giant Eagle in connection with the Entries will be subject to Giant Eagle’s privacy policy (“Privacy Policy”) available at https://account.gianteagle.com/PrivacyPolicy#privacy. By submitting an Entry, you agree to GiantEagle’s Privacy Policy.

If an Entrant chooses to opt in to receive communications from Giant Eagle, his or her personal information will be subject to Giant Eagle’s Privacy Policy and terms of service (if applicable).

RELEASE OF LIABILITY: Giant Eagle expressly disclaims any responsibility, and Entrants agree to indemnify and hold harmless Giant Eagle from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Sweepstakes (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any Prize awarded.

TAXES:  All federal, state, local, or other taxes and any other costs and expenses associated with the acceptance and/or use of prizes not specifically provided for in these Rules are solely the Potential Winner’s responsibility. PotentialWinner is solely responsible for reporting and paying any and all applicable taxes. United States residents may have prizes reported to the IRS and may receive an IRS Form 1099. Please contact your own tax advisor for any questions concerning taxes.

ARBITRATION: BY ENTERING INTO THE SWEEPSTAKES, ENTRANT AGREES THAT ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS SWEEPSTAKES (INCLUDING, WITHOUT LIMITATION, ITS PRIZING) OR RELATING TO THESE OFFICIAL RULES, THEIR ENFORCEMENT, ARBITRABILITY OR INTERPRETATION, SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION, TO BE HELD IN PITTSBURGH Pennsylvania, BEFORE A SINGLE ARBITRATOR. THE ARBITRATOR SHALL BE SELECTED BY MUTUAL AGREEMENT OF THE PARTIES OR, IF THE PARTIES CANNOT AGREE, THEN BY SELECTING AN ARBITRATOR FROM A LIST OF ARBITRATORS SUPPLIED BY JAMS (JUDICIAL ARBITRATION AND MEDIATION SERVICES).  IF THE PARTIES STILL CANNOT AGREE ON AN ARBITRATOR, THE ARBITRATOR SHALL BE APPOINTED BY JAMS. THE ARBITRATION SHALL BE A CONFIDENTIAL PROCEEDING, CLOSED TO THE GENERAL PUBLIC.  ALL CAUSES OF ACTION ARISING OUTOF OR CONNECTED WITH THE SWEEPSTAKES OR THE PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.  THE ARBITRATOR SHALL ISSUE A WRITTEN OPINION STATING THE ESSENTIAL FINDINGS AND CONCLUSIONS UPON WHICH THE ARBITRATOR’SAWARD IS BASED.  JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.  THE PARTIES WILL SHARE EQUALLY IN PAYMENT OF THE ARBITRATOR’S FEES AND ARBITRATION EXPENSES AND ANY OTHER COSTS UNIQUE TO THE ARBITRATION HEARING (RECOGNIZING THAT EACH SIDE BEARS ITSOWN DEPOSITION, WITNESS, EXPERT AND ATTORNEYS’ FEES AND OTHER EXPENSES TO THE SAME EXTENT AS IF THE MATTER WERE BEING HEARD IN COURT). NOTWITHSTANDING THE FOREGOING, THE ARBITRATOR MAY REQUIRE THAT SUCH FEES BE BORNE IN SUCH OTHER MANNER AS THE ARBITRATOR DETERMINES IS REQUIRED IN ORDER FOR THIS ARBITRATION CLAUSE TO BE ENFORCEABLE UNDER APPLICABLE LAW.

GOVERNING LAW: Each Entrant acknowledges that the internal substantive laws (as distinguished from the choice of law rules) of the Commonwealth of Pennsylvania and the United States of America applicable to contracts made and performed entirely in Pennsylvania shall govern the validity and interpretation of these Official Rules and all other causes of action (whether sounding in contract or in tort) arising out of or relating to these Official Rules and/or the Sweepstakes.
